This would have happened to several Peruvians who managed to acquire the equipment in pre-sale; However, this is not the first time that users have been surprised with this control measure.

In September of last year, Sunat carried out a similar operation: the seizure of the new ones was ordered iPhone 14 to all travelers arriving in the national territory. This was due to the fact that the aforementioned devices did not have the approval granted by the Ministry of Transport and Communications (MTC).

As detailed in the official government portalthrough homologation, the TCM verifies that telecommunications equipment and devices, such as cell phones, smartphones, tablets, transmitters, among others, meet certain technical characteristics that allow them to operate in the national territory, in accordance with Peruvian standards.

This Supreme decret It became effective in 2006, when the Executive approved the Specific Regulation for Homologation of Telecommunications Equipment and Devices, under the responsibility of the TCM. However, it was not until 2019 that the modification of said regulation was approved.

It is worth mentioning that any natural or legal person can request the approval of electronic devices that have not previously gone through this process. As indicated by the Regulationthis is a right that mobile equipment distribution companies can exercise.

“When the equipment and/or device is brought into the country by a natural person for personal use, it is their responsibility to obtain the approval certificate,” indicates one of the complementary provisions of the standard.

He Ministry of Transport and Communications implemented a search engine to find out all the devices approved for approval. In this list, there are four type approval certificates that are compatible with the iPhone 15on models A3090, A3094, A3102 and A3106.

However, according to a report from El Comercio, these copies are not those designed for the United States market and some regions in Asia, such as China. The devices seized at the Jorge Chávez airport correspond to those exclusive designs for North America and part of Central America, such as Puerto Rico.

According to article 88 of the Telecommunications Lawthe installation, operation, distribution and sale of equipment without an approval certificate incur a serious infraction that could lead to a fine of up to 150 Tax Tax Units (UIT) or 742,500 soles.
