Toledo’s defense argues that the former president should be released given that he has already exceeded the 18 months of preventive detention initially imposed by Carhuancho in 2017. However, Judge Víctor Zúñiga refuted this approach, highlighting that the term of preventive prison It began counting from Toledo’s return to Peru, on April 23, 2023, after his extradition, which sets the expiration of the measure for October 2024.
The appeal will now be considered by the First National Criminal Court of Appealswhich must set a virtual hearing to evaluate the arguments presented by Toledo’s defense, with the participation of all parties involved in the process.
In parallel to this context, the prosecutor José Domingo Pérez Gómez has requested a sentence of 20 years and six months in prison for Toledo, in addition to a nine-year disqualification from holding public office, accusing him of collusion and money laundering.

The tax investigation revealed that Ecoteva would have served as a vehicle to hide and launder money obtained through allegedly illicit means, including bribes that would have been received by Toledo. Through this company, two luxury properties were purchased in Lima and mortgages associated with the former president were paid.
