The Taganrog prosecutor’s office helped the mother to receive child benefits

In Taganrog, the city prosecutor’s office sued for a monthly allowance for a mother for a ten-year-old child.

According to the supervisory authority, as a result of the audit, it was found that the woman applied twice to the branch of the Pension Fund of Russia in the Rostov region (in July and September last year) with applications for the appointment of benefits. She attached to the documents a court order on the recovery of alimony for the maintenance of her minor son. However, the Pension Fund issued a refusal decision due to the applicant’s inconsistency with the status of a single parent – the woman is in a registered marriage with the father of the child.

The submission made in November last year by the regional prosecutor’s office to the head of the OPFR was left without satisfaction, in connection with which, the city prosecutor’s office initiated judicial protection of the rights of mother and child. However, by decision of the Kirovsky District Court of Rostov, the claim was denied. The prosecutor of Taganrog filed an appeal against this decision.

On November 28 of this year, the decision of the Kirovsky District Court was canceled by the appeal ruling of the Judicial Collegium for Civil Cases of the Rostov Regional Court and a new decision was made to satisfy the claims.

The court decided to oblige the OPFR to assign a monthly allowance for a child from the moment the woman first applied, that is, from July last year. The execution of the court order is controlled by the city prosecutor’s office.
